Moses Gatama Njoroge has been sentenced to five years in prison for his role in throwing his ex-girlfriend off the 12th floor of the Ambank House building in Nairobi Central Business District (CBD).

Milimani principal magistrate Esther Kimilu on December 1, 2022, convicted Moses after the court found him guilty of causing grievous bodily harm to Eunice Wangari Wakimbi.

“I note the mandatory sentence is life imprisonment but due to the remorsefulness of the accused and the commitment to change, has persuaded me to jail him to five years in prison,” the magistrate ruled.

The magistrate did not give the convict an option of a fine. She said that the victim is still undergoing treatment two years since the incident occurred.

Kimilu in her ruling noted that she had considered the accused person was committed to rehabilitation due to alcoholism and anger issues according to the report.

The same court on November 17, 2022, ruled that Moses was guilty of causing grievous bodily harm to Eunice.

The magistrate cited medical records that outlined the woman’s injuries inflicted.

“The victim was immobilised for a couple of months and could not stand without crutches at the time she was giving her testimony,” Kimilu said.

After the conviction on November 17, the court set December 1, 2022, as the date when Moses was to be sentenced.

Moses was charged with one count of causing grievous bodily harm after he threw Eunice off the 12th floor of the Ambank house on September 13, 2020.

As the two were imbibing an alcoholic drink, Eunice said she rebuffed Moses’ sexual advances, angering him and leading to the fight that saw her being thrown from a window on the 12th floor but luckily she landed on the 9th floor.

Eunice, who spent two months at Kenyatta National Hospital (KNH), told the court that on September 13, 2020, she travelled from her Karura home in Kiambu County to Nairobi’s CBD to meet her new boyfriend whom she met on Facebook.

She had told her mother that she was going to meet her boyfriend in Nairobi.

When she arrived, Eunice told the court that she informed Moses of her arrival in the city centre. He told her to head to the Ambank House where his office was situated.

She said Moses found her at the Ambank House’s reception and took her to the 12th floor where they spent time together and later decided to go out for lunch.

The two went to Simbiza hotel where they bought two pieces of chicken and chips and then proceeded to Naivas Supermarket on Moi Avenue where they purchased an alcoholic drink, the 750ml Captain Morgan, and soda.

They then returned to Ambank House where they enjoyed their meal and washed it down with the whisky.

Eunice told the court that they drank until 7.30 pm when she decided to leave but to her surprise, Moses did not like the idea. She said he wanted her to spend the night with him.

An argument quickly ensued that led to a fight, she said.

During the fight, Eunice said Moses threw her through a window on the 12th floor and she landed heavily on the 9th floor.

She suffered serious pelvic injuries and was taken to KNH for treatment and the matter was reported to the authorities.
