The law Society of Kenya (LSK) has condemned the Malindi law courts incident where an elderly man charged with obtaining money by false pretences accused the court of unfairly handling his case. 

The LSK Coast Branch Vice Chairman and Malindi Branch Chair Conrad Atiang said the utterances in the video that circulated on social and mainstream media about Carlos Taka decrying delay in conclusion of his case were unnecessary.

Addressing a press conference on Monday during the beginning of the legal awareness week he said the continuous such attacks targeting the courts affect the autonomy and independence of the judiciary.

“Whereas there could be some legitimate concerns about what the gentleman was complaining about we cannot entertain them and we must condemn in the strongest such comments that insinuate that Malindi law courts or any particular court for example are courts considered useless, ” he said.

Last Week Taka caused drama before Malindi Resident Magistrate Olga Onalo where he protested over delayed justice.

“This is the most useless court in the world because I have been in remand for one year just because of a few witnesses. Justice delayed is justice denied. I claim the privileges of a Kenyan of my age. I am not happy,” said Taka in a video that went viral on social media

Taka has been in remand for over one year and is facing charges of obtaining money by false pretences.

The court, however, considered bond terms which were made available for him but has since not been able to pay.

“If the court has availed avenues for someone to stand trial from outside then such a person cannot come back and blame the judiciary for not availing liberty to them or expeditious disposal of the trial,” he said.

Atiang noted there was need for the LSK to collaborate with Judiciary to offer probono services to the elderly who are undergoing trial.

Taka was charged that on September 21 2021 at Malindi old Court in Malindi Sub County within Kilifi County with intent to defraud obtained Sh. 3,500 from Mary Masia by falsely pretending that he was in a position to employ her at Malindi International Airport as an office messenger, a fact he knew to be false.

He also obtained Sh. 6,500 from Jacqueline Santa Thoya between 12th June 2021 and 20th June 2021 at Gede area by falsely pretending that he was in a position to employ her at Mercy USA NGO as a field officer a fact he knew to be false and four other counts of similar nature.

Taka is also accused of personating a public officer contrary to section 105 (a) of the penal code where on 21st September 2021 at Malindi old court

He falsely presented himself to be a person employed in the public service to Mary Masisa as the head of the presidential delivery Unit in monitoring the drought situation in Kilifi and took a registration fee of sh. 1,000 from her.
