There was drama and laughter at an Eldoret court after a security guard accused of assaulting three p****e pleaded with the court to buy him his favourite meal, a plate of ugali.
While appearing before presiding judge Keynes Odhiambo, the accused, Japheth Olindo, told the court that he was unable to concentrate on the proceedings since he had not eaten.
He also decried that he would collapse from hunger.
In his response to the accused, the judge promised to buy lunch after the hearing of the case.
Olindo also pleaded with the court to release him on Ksh2,000 bail claiming that if he stayed in prison for too long, his wife will be taken away from him by other men.
The accused is said to have assaulted three p****e in a Sugoi neighbourhood on Friday, March 10, 2023.
He denied the charges and was released on a cash bail of Ksh10,000.
The Thika law court heard that the accused, Simon Nderitu Mwangi committed the offence at Ndarasha village in Juja constituency, Kiambu county on different dates between 2020 and 2021.
A medical report tabled before the court revealed that the complainant who was a high school student at the time had injuries around his a**s.
The court heard that the accused had introduced himself to the parents of his victim as a pastor. It was revealed that he used to buy gifts and give money to his victim as a way of luring him.
In his defence, the accused told Chief Magistrate Stella Atambo, that he had no regrets since he was homosexual.
He subsequently asked the court why he was being condemned for his s****l preference.
Mwangi recounted that they met frequently in groups, and further revealed that there were many other homosexuals like him who interacted in different towns and on the internet.
He disclosed that some of those in the group were form one students.
“Why am I being crucified for my s****l preference?” he posed.
The accused was charged with two s****l offences of rape and s****l harassment. He denied the first count and pleaded g****y to the last count.
