In a Gazette notice dated October 31, 2024, the swearing-in ceremony is scheduled to take place on Friday, November 1, 2024, at the Kenyatta International Convention Centre (KICC) in Nairobi at 10 am.
“It is notified for the general information of the public that the swearing-in ceremony of the Deputy President-designate shall take place on Friday, November 1, 2024, at the Kenyatta International Convention Centre (KICC), in Nairobi City County, from 10.00 o’clock in the forenoon,” the notice, signed by Mercy Wanjau, the Chairperson of the Assumption of the Office of Deputy President Committee, read.
The conservatory orders had initially delayed Kindiki’s official assumption of duties, leaving uncertainty over the transition process.
However, the High Court’s decision offered the green light, allowing the transition to move forward.
Former Deputy President Rigathi Gachagua had contested the Senate’s decision leading to his impeachment, seeking orders to challenge it.
However, Justice Anthony Mrima highlighted the importance of keeping the Deputy President’s office occupied in the public interest. Justice Eric Ogola noted that the conservatory orders previously granted by the Kerugoya High Court on October 18, 2024, had now been lifted.
“We are convinced and find that the current constitutional framework does not envision any scenario in which the office of the DP would remain vacant except during the brief period required to fill a vacancy,” Justice Mrima stated.
“The applications for conservatory orders are hereby disallowed. The conservatory orders on October 18, 2024, in Kerugoya High Court are hereby discharged,” Justice Ogola said.
The judges scheduled the case for a mention on November 7, 2024, also noting that Gachagua could appeal their decision.
“The applications for conservatory orders are hereby disallowed. The conservatory orders issued on October 18, 2024, in Kerugoya High Court are hereby discharged and/or set aside. We grant leave for appeal. Typed proceedings and certified copies of this ruling are to be availed to parties at cost. We will mention this matter on November 7, 2024, at 2 pm in the open court,” the judges said.
Kindiki has been serving as the Cabinet Secretary in the Ministry of Interior and National Administration.
