Heavy police presence has been deployed at Parliament buildings ahead of Deputy President Rigathi Gachagua’s Senate impeachment trial.

DP Gachagua’s Senate impeachment trial follows after a three-judge bench declined to stop his impeachment trial. 

“It is our view that this is not one such case where intervention is automatic. The issues raised by the parties will be required to be interrogated. We therefore find that the enhancement of the Constitutional principle of separation of powers will be best served by declining the application at this point,” the court ruled. 

This came a day after the High Court rejected his request for conservatory orders to stop his impeachment proceedings in the Senate. 

In a ruling rendered on Tuesday, October 15, 2024, Justice Chacha Mwita stated that the prayers by the DP’s legal team would not be granted. 

The judge, however, stated that some of the issues raised were of considerable concern. 

“In considering the application and the argument by parties, the prayer for grant of conservatory order is declined,” Justice Mwita ruled.

The DP who is facing 11 charges, had filed 26 court cases challenging the legality and process of his removal from office by impeachment.
