The Anti-Corruption Court in Nairobi has allowed the Director of Criminal Investigations (DPP) Noordin Haji’s request to withdraw Ksh7.3 billion graft charges against Deputy President Rigathi Gachagua and nine of his co-accused.

Magistrate Victor Wakumile, however, warned the accused persons that they may be rearrested in future over the same charges should investigators find new evidence.

The court has also recommended the enactment of a law to establish office of a pre-trial judge to be checking on whether there is sufficient evidence before any accused person is arraigned in court.

While issuing the recommendations, Wakumile noted that it was unfair to subject judicial officers to take lengthy notes when there is no case.
