Retired President Uhuru Kenyatta has been confirmed as the Jubilee party leader by the court.
In a ruling on Monday, September 30, 2024, the High Court kicked out Sabina Chege as the party leader.
According to the court ruling, Uhuru is the party leader and the only authority that can call party meetings.
Kanini Kega has been kicked out as the secretary general as well as Adan Keynan who was serving as the vice chairperson.
The court has also declared null and voin the National Executive Committee that kicked out vice chairperson David Murathe, secretary general Jeremiah Kioni and Kagwe Gichohi.
The Court has also ruled that Kioni, Murathe and Kagwe sufficiently exhausted the party’s internal dispute resolution mechanisms before filing their appeal.
“The appellants demonstrated attempt to sufficiently exhaust the Party’s IDRM • The PPDT majority misdirected themselves and therefore arrived at an erroneous finding. The decision of the majority is set aside,” the court ruled.
The court has also ruled that the notice on February 2, 2023, to eject the aggrieved members, was illegally and improperly issued.
“The same and everything arising therefor is accordingly a nullity,” the court added.
Also, the court found that the Nakuru NEC meeting was held in blatant breach of the law and the party constitution. The resolutions of that meeting have been declared null and void.
Initially, in a letter dated May 9, 2023, Registrar of Political Parties Ann Nderitu said the process of the removal of the three was in accordance with the laws of the party.
“Following a review of the submitted documents in line with the PPA and the party constitution, this Office is satisfied that the party adhered to the due process. Accordingly, pursuant to Section 34(da) of the PPA, this Office has updated its records and the register of party members,” Nderitu says.
Nderitu had also dismissed a NEC meeting convened by Uhuru on April 28, 2023, on the grounds that the meeting did not meet the threshold of attendees.
“Article 23 of the party constitution provides that quorum for all meetings for all party organs is one-third of the membership entitled to attend. The list of attendees for the April 28, 2023 meeting comprises nine individuals with two attendees, Hon. Maison Leshoomo and Mr. Polycarp Hinga, who were yet to assume office,” she stated.
