Eldoret High Court Judge Robert Wananda has issued a warrant of arrest  against a senior cybercrime detective officer attached to the DCI headquarters in Nairobi for failing to appear in court in a murder case where an Eldoret based lawyer is charged with stabbing his colleague with a broken bottle of beer to death.

The Judge issued the arrest warrant after the officer Daniel Kieni for skipping on several occasions to turn up in court as ordered to present CCTV footage as key evidence in the court proceedings.

Justice Wananda argued that Kieni’s action has made it hard for the

State Counsel to prosecute the matter to conclusion, thus causing several adjournments of the murder case every time it come up for hearing.

While issuing the order for his arrest, Justice Wananda described the character of the said officer as strange behavior which is contributing to the delay in the matter which has been pending in court for more than five years.

“The cybercrime unit officer had been lined up to testify during the last hearing but instead failed to turn up despite being summoned and promised to appear in the next hearing date which he also skipped,” stated Justice Wananda.

He noted that the officer has neither appeared physically or virtually nor given sufficient explanation as to why he did not appear either virtually or physically,” stated the Judge.

Justice Wananda who was perturbed by the action of the officer issued

a warrant of arrest to the officer in charge of cybercrime at DCI headquarters in Nairobi to implement the arrest order.

The Judge regretted that the character of such officers has continued to contribute to delay of cases in courts subjecting the court to blames from litigants.

“The warrant of arrest is hereby issued against the cybercrime officer namely inspector Daniel Kieni of the cybercrime unit attached to the DCI headquarters in Nairobi. The warrants are to be affected by officers in charge of cybercrime unit DCI Nairobi, “directed Justice Wananda.

The accused lawyer Abel Mogaka is alleged to have killed his colleague Calvin Ngaira during a three day house party among buddies which turned tragic after the accused stabbed his colleague with a broken beer bottle leading to his death.
